This article examines the absence of biological relatedness in couples where the use of a third-party gamete donor casts doubt on the notion of conventional kinship. The authors observe that individuals who have used technology to create a family remediate relatedness through a dehistoricized idea of kinship in which the traditional concept is replaced with the concept of chance. The article also examines how inherited value is replaced by strategies that redefine the ways in which donor gamete parents can pass (...) their values on to their children. American undergraduates rated masculinity, femininity, and likability of two men from a videotaped interaction. Participants were informed that both men were cat persons, dog persons, heterosexual, adopted, or gay, or were unlabeled. Participants rated the men less masculine when cat persons than when dog persons or unlabeled, and less masculine and more feminine when gay than when anything else or unlabeled. The more masculine man received lower feminine ratings when a dog person than when a heterosexual, and higher masculine ratings (...) when a dog person than when unlabeled. Labels did not affect likability. Overall, the gay label consistently promoted cross-gender attributions, the dog person label encouraged somewhat heightened gender-appropriate attributions, and the cat person label allowed for normative attributions. A guide to Nietzsche's most personal book.

Upon the release of Brokeback Mountain, the conservative film critic, Michael Medved, in a television interview, predicted that a gay western – or maybe he called it a gay cowboy movie – would not attract an audience, presumably on grounds that the intersection of the audience for gay movies and the audience for westerns would yield, as the logicians say, the null set. Medved was proven wrong, as Brokeback, which cost $14 million to produce, went on to earn $83 million (...) on first release in the United States (plus $95 million abroad). But Medved was also wrong in his initial description. Although rodeos, horses, and cattle percolate through the film, Brokeback does not fit the classic American Western movie storyline. From the films of William S. Hart and Tom Mix down through Gary Cooper in The Virginian and High Noon, John Wayne in Stagecoach, Alan Ladd in Shane, and Clint Eastwood in The Unforgiven, the Western hero wears a cowboy hat, rides a horse, and carries a gun. His ultimate goal is to save the good folks from the bad guys, and he always succeeds. Brokeback, of course, is not like these films at all. Jack Twist and Ennis Del Mar are not engaged in the Westerner’s project of vanquishing evil. In fact, Ang Lee’s film more closely resembles the stories of such star-crossed lovers as Abelard and Heloise, Tristan and Isolde, and Romeo and Juliet. More interestingly, it fits a narrative pattern common in the nineteenth-century operas of Bellini, Donizetti, Verdi, and Wagner. In.. (shrink)

Give style to your character, a great and rare art.Nietzsche Gay Science What are we to make of Nietzsche? There has been an explosion of scholarship over the past twenty years, much of it revealing and insightful, a good deal of it controversial if not polemical. The controversy and polemics are for the most part straight from Nietzsche, of course, and the scholarly disputes over what he ‘really’ meant are rather innocuous and often academic compared with what Nietzsche meant with (...) his conscientiously inflammatory rhetoric and hyperbole. We have been treated to extended debates about Nietzsche's politics, his attacks on Christianity and morality, his famed notion of the übermensch and his less lampooned doctrine of the ‘eternal recurrence’. We have recently heard Nietzsche reinterpreted as an analytic philosopher, as a deconstructionist, as a feminist, even as a closet Christian and a liberal. Stephen Aschheim suggests in his recent book that Nietzsche provides us with something like a Rorschach test, inviting readers with amazingly different commitments and ideologies to ‘make their own Nietzsche’. But there is another approach to Nietzsche, something quite different from interpreting him in terms of his various ‘theses’ and positions, unpacking his ‘system’ or repeating unhelpfully that he displayed no such coherence and consistency, something more than finding out ‘who’ Nietzsche is as opposed to what we have made out of him. The simplest way of getting at this alternative approach might be to ask, what Nietzsche would make of us? I grant that this is a bit cryptic, and it invites a variety of unflattering answers. But I think it is very much in the spirit of what he are all about. It is an intimately personal approach to Nietzsche, an approach that will, no doubt, be somewhat different for each and every one of us. But that, too, of course, is just what Nietzsche would have demanded. (shrink)

Myriad contemporary public-policy issues--including physician-assisted suicide, medical marijuana, abortion, surrogate motherhood, gay rights, conscription, and markets in human organs--raise the following important question: what rights should individuals have over their own bodies? The concept of self-ownership offers one way to answer this question. Just as ownership of an external object involves having rights, liberties, powers, immunities, etc., with respect to it, so self-ownership involves having these incidents of ownership with respect to one's own body and labor power. Much of the (...) contemporary debate over self-ownership has been about which of these incidents should be included in its definition. This dissertation endorses a particular configuration of incidents called Control Self-Ownership, consisting of permanent rights in rem of use, exclusion, and transfer over one's own body and labor power. As I show, this conception of self-ownership is coherent--two of its incidents can be either directly or indirectly derived from the third--but it creates difficulties for the political theorists who use it. For example, liberal egalitarians' tentative adoption of CSO forces them to be not only more liberal but also less egalitarian than they would otherwise be, whereas libertarians' efforts to adopt CSO but also extend it to include a right to labor income are unsuccessful, leaving their opposition to redistributive labor taxation ungrounded. The dissertation also shows that CSO can act as a mediating concept between the abstract political value of autonomy and a variety of concrete policy prescriptions, including the decriminalization of victimless crimes and the abolition of forced labor. More specifically, I demonstrate that CSO is tightly linked to autonomy by developing two distinct but interrelated Kantian defenses of it. I also argue that CSO is highly inconsistent with several existing and proposed nonmarket institutions to allocate transplantable human organs but that it can provide moral support for markets in human organs. Friedrich Nietzsche is one of the most elusive thinkers in the philosophical tradition. His highly unusual style and insistence on what remains hidden or unsaid in his writing make pinning him to a particular position tricky. Nonetheless, certain readings of his work have become standard and influential. In this major new interpretation of Nietzsche’s work, Robert B. Pippin challenges various traditional views of Nietzsche, taking him at his word when he says that his writing can best be understood as (...) a kind of psychology. Pippin traces this idea of Nietzsche as a psychologist to his admiration for the French moralists: La Rochefoucauld, Pascal, Stendhal, and especially Montaigne. In distinction from philosophers, Pippin shows, these writers avoided grand metaphysical theories in favor of reflections on life as lived and experienced. Aligning himself with this project, Nietzsche sought to make psychology “the queen of the sciences” and the “path to the fundamental problems.” Pippin contends that Nietzsche’s singular prose was an essential part of this goal, and so he organizes the book around four of Nietzsche’s most important images and metaphors: that truth could be a woman, that a science could be gay, that God could have died, and that an agent is as much one with his act as lightning is with its flash. The American Psychological Association's (APA's) as well as other professional organizations' (e.g., American Psychiatric Association) removal of homosexuality as a mental disorder represented a paradigmatic shift in thinking about exual orientation. Since then, APA (2000) disseminated guidelines for working with lesbian, gay, and bisexual (LGB) clients, and a variety of scholars and researchers alike have advocated affirmative therapeutic interventions with LGB individuals. Despite these efforts, the controversy over treating individuals with LGB orientations using nonaffirmative techniques continues. In this discussion, the (...) limited evidence regarding the efficacy and effects of conversion therapy is surveyed, particularly in the context of empirically supported treatment criteria summarized by Division 12 (clinical psychology) of the APA. Authors then consider the resulting ethical considerations in performing conversion therapy and propose alternative uses of affirmative therapy on the basis of ethical standards defined by APA. Finally, options for treating LGB individuals who are coming to terms with their sexual orientations are discussed. (shrink)

The Hippocratic oath is such an enduring icon of medical morality that physicians in Nazi Germany invoked it to protest _Euthanasie_, the systematized killing of weak or sick children, people with incurable diseases, hospitalized criminals (a category applicable to gays), geriatric patients, long-term patients, patients not of German blood (Jews and Romani), and people with disabilities. Several expert witnesses at the 1945 Nuremberg Medical Trial also cited the oath to condemn Nazi physicians' abuse of human research subjects. Noting these invocations, (...) in 1947 the physicians who founded the World Medical Association modernized the Hippocratic oath to convey to future medical students its foundational precepts: benefitting the sick, not harming them, not breaching confidentiality, and not treating patients unjustly, irrespective of their gender or social status. This article presents a historically accurate reading of the oath's strange-seeming passages to show that it does not prohibit abortion, euthanasia (medical aid in dying), or surgery. The article also contends that oath-swearing remains an important asset in teaching clinicians their role responsibilities, and that its ethics supports women's rights to reproductive health care and can valorize challenges to venture-capitalist and for-profit managements that prioritize profitability over providing quality health care for patients. The “new natural lawyers” (NNLs) are a prolific group of philosophers, theologians, and political theorists that includes John Finnis, Robert George, Patrick Lee, Gerard Bradley, and Germain Grisez, among others. These thinkers have devoted themselves to developing and defending a traditional sexual ethic according to which homosexual sexual acts are immoral per se and marriage ought to remain an exclusively heterosexual institution. The sterility objection holds that the NNLs are guilty of making an arbitrary and irrational distinction between same-sex (...) couples and sterile heterosexual couples. The NNLs believe that it is a necessary condition for two people’s being morally and legally entitled to get married that they be able to perform sexual acts that are “suited to procreating.” But sterile heterosexual couples are incapable of performing such acts. Therefore, it should follow from the NNLs’ own premises that sterile heterosexual couples are not entitled to marry. But the NNLs do not draw this conclusion. Instead, they maintain that sterile heterosexuals can marry while denying that the same is true of same-sex couples. The sterility objection claims the NNLs are being inconsistent in treating the two kinds of couples differently. Although the sterility objection has been endorsed by recent critics, I don’t think it has yet been adequately defended. The NNLs have responded by arguing that there is a sense in which the sex acts of sterile heterosexual couples are as suited to reproduction as those of fertile heterosexuals. Thus they maintain that the distinction they draw between the two kinds of couple has a rational basis. A successful defense of the sterility objection must show that this response on the part of the NNLs fails. Such is the task I undertake in this paper. I argue that the NNLs’ response fails because acts of penile-vaginal intercourse between sterile heterosexuals lack the actual causal power to produce conception that sexual acts need to be considered truly reproductive, and because their assumption that penile-vaginal intercourse always functions reproductively is bad biology. The last half of Leviathan is designed to refute these claims in detail, and this refutation is not merely tacked onto the first parts but is a logical extension of them. The argument for escaping the state of nature is that only through obedience to a (...) common power can man escape the likelihood of an early death. Once that common power is established, and so long as it can carry out its protective function, obedience to it is obligatory. When a man enters civil society, the only right he retains is to defend himself against physical death, and consequently, the only time he is entitled to disobey the sovereign is when the sovereign directly threatens him. Thus excuses for rebellion are reduced to an absolute minimum. In McNeiily's formalization however, the concept of a man's death must be replaced by the formal concept of the frustration of all one's desires. And so "whatevvr [a man] regards as the complete frustration of all his desires... he will be entitled to resist, even if such resistance puts him at war with others, including lawful authority" (p. 193). Now the incredible range of things men have believed essential to avoiding the frustration of all their desires is amply testified to in the history of religious warfare. And clearly, under this formalized interpretation, men would be entitled to rebel over the form of baptism, church government, ministerial costume, prayer, or anything else if they are convinced it is essential to their salvation. It takes little knowledge of history to see that Hobbes's espousing of a theory with such consequences has a low degree of probability indeed. Hobbes complains in Leviathan of Scriptural exegetes who "by casting atoms of Scripture, as dust before men's eyes, make everything more obscure than it is." Rather, he claims, it is "not bare words, but the scope of the writer, that giveth the true light by which any writing is to be interpreted; and they that insist upon single texts, without considering the main design, can derive nothing from them clearly'" (E. What is the proper balance between legislative and judicial innovation and between formal and functional family recognition once legislatures have addressed gay men’s and lesbians’ families? In the civil-law jurisdiction of Quebec, legislative reforms allow two women to register as a child’s mothers. But judges have recognized a second mother ‘in fact’ by orders sharing custody where the parties had not used the new legislative channels. Such judicial creativity is reconcilable with the civil law and comparative scholars should flag it (...) as a valuable resource. But it risks undermining legislative choices about family recognition. Perhaps the option to give a child a second mother includes the choice for a lesbian birth mother not to do so. It is not merely an aesthetic category, but one that encompasses the very character of self-determining (or "self-creating") agency. The tragic character of self-determining agency, I shall claim, stems from the conflict between the (...) local, practice-dependent character of our normative commitments and their transcendent purport. My argument will run as such. Becoming what one is, according to Nietzsche, is a matter of taking a particular place in a narrative of self-creation. Such narratives are teleological: they are structured by a kind of directionality (or, more broadly, by "ideals") that cannot, practically, be taken as arbitrary. But these narratives are inevitably incomplete, and so therefore are the norms and selves that depend on them.The very project of a genealogy of morals supports my first claim, that becoming what one is involves a matter of taking a particular place in a narrative of self-creation. 1 The Genealogy of Morals begins with the declaration that we are unknown to ourselves, and the explanation it provides of this shortcoming, that we have never sought ourselves, is expanded by means of a temporal metaphor: the bell-strokes of our life that we do not think to reckon until after they have passed. What we have failed to accomplish, and what the genealogy attempts to recover, is a diachronic account of who we are. This missing story covers the singular as well as the collective "we." Of course it does not follow from this that everything indefinable has a history, but the special elusiveness of modern individuality seems due to the complexity of its narrative source. And not only individuality in general, but also the particular individual, seems to have a narrative basis. In the book subtitled "How one becomes what one is," in the section that promises the "real answer to the question, how one becomes what one is" (EH "clever," 9), Nietzsche offers this account of personal development:One must keep the entire surface of consciousness—consciousness is a surface—clean of any great imperatives. In recent years there have been substantial changes in approaches to how genders are made and what functions genders fulfill. Most of the scholarly focus in this area has been in the areas of feminist, gay, and lesbian studies, and heterosexual masculinity - which tended to be defined by lack and absence - has not received the critical and scholarly attention these other areas have received. _Heterosexual Masculinities _rethinks a psychoanalytic tradition that has long thought of masculinity as a sort (...) of brittle defense against femininity, softness, and emotionality. Reflecting current trends in psychoanalytic thinking, this book seeks to understand heterosexual masculinity as fluid, multiple, and emergent. The contributors to this insightful volume take new perspectives on relations between men, men’s positions as fathers in relation to their sons and daughters, the clinical encounter with heterosexual men, the social contexts of masculinity, and the multiplicity of heterosexual masculine subjectivities. What to a previous generation would have appeared as pathological or defensive, we now encounter as forms of masculine subjectivity that include wishes for intimacy, receptivity, and surrender, alongside ambition and the pleasures of "phallic narcissism.". Although clinical ethics consultation is a high-stakes endeavor with an increasing prominence in health care systems, progress in developing standards for quality is challenging. In this article, we describe the results of a pilot project utilizing portfolios as an evaluation tool. We found that this approach is feasible and resulted in a reasonably wide distribution of scores among the 23 submitted portfolios that we evaluated. We discuss limitations and implications of these results, and suggest that this is a significant step (...) on the pathway to an eventual certification process for clinical ethics consultants. Abstract Struck by essentialist and anti-essentialist elements in his writings, Nietzsche's readers have wondered whether his conception of the self is incoherent or paradoxical. This paper demonstrates that his conception of the self, while complex, is not paradoxical or incoherent, but contains four distinct levels. Section I shows Schopenhauer as Educator to contain an early description of the four levels: (1) a person's deepest self, embracing all that cannot be educated or molded; (2) a person's ego; (3) a person's ?ideal? (...) or ?higher self?; (4) a person's ?true self? or ?true nature?. In the remaining three sections, I show that Nietzsche develops and enriches this conception, without ever abandoning it. Section II treats the fourfold conception as it appears in Human, All Too Human. Section III interrogates relevant passages in the Gay Science, showing that while Nietzsche speaks of artful self-fashioning (as Alexander Nehamas emphasizes), he also pays due regard to the sense in which we are not our own creations. Section IV turns to the ?deepest? level of the self, consisting of motives and drives. Drawing primarily upon Daybreak and Beyond Good and Evil, I show that Nietzsche regards neither the drives nor their hierarchical ordering as things that we construct. (shrink)

In his “Translator’s Introduction” to The Gay Science, Walter Kaufmann writes: “This book … mirrors all of Nietzsche’s thought and could be related in a hundred ways to his other books, his notes and his letters. And yet it is complete in itself. For it is a work of art.” Judging by their actual treatment of The Gay Science, few commentators have taken this claim to artistic completeness seriously. Instead, the usual practice has been to abstract passages from the book, (...) treating them either as initial statements of key Nietzschean doctrines or as casting light on general issues raised throughout Nietzsche’s works. Until now, no commentator of note has attempted an interpretation of The Gay Science as a unified whole. It is to this end that Higgins has written Comic Relief. (shrink)

In this essay, I attempt to consider a difficult issue: the triangular relationship between the subject, the object and the visual representations of masculinity in the context of male homosexual desire. I outline contemporary circumstances of society’s interaction with popular culture in which gay men form two images of an idealized masculine body: a concept of their own body and a concept of the body they feel sexually attracted to. My concern is to theorize these two kinds of desire and (...) position them in the chaotic landscape of contesting masculinities that increasingly often besiege men via visual media. I differentiate between “straight” and “gay” masculinities as historically they have been represented and negotiated independently. What I want to reflect on is in what ways these masculinities can impact on gay men’s desires—to be a man, and to have a man. Approaching this task produces a rather puzzling picture as interpreting contemporary visual culture poses more questions than it gives answers. I argue that some of these questions are worth pursuing as an empirical inquiry. My objective is to provide a theoretical background such work could be based on. I locate elements of this theory that I find problematic or out-of-date and mention certain aspects of the problem that I believe could be addressed further. (shrink)

The use of deception in medical care is highly suspect in this country. Yet there is one condition for which deception is often used as a diagnostic tool. Nonepileptic seizures, a psychiatric condition in which emotional or psychological conflicts manifest themselves unconsciously through bodily symptoms, are currently diagnosed by a procedure called “provocative saline infusion.” The test is fundamentally deceptive, requiring the physician to intentionally and directly lie to the patient, causing the patient to believe that the administered solution caused (...) his seizures. Foundations of Economic Personalism is a series of three book-length monographs, each closely examining a significant dimension of the Center for Economic Personalism's unique synthesis of Christian personalism and free-economic market theory. In the aftermath of the momentous geo-political and economic changes of the late 1980s, a small group of Christian social ethicists began to converse with free-market economists over the morality of market activity. This interdisciplinary exchange eventually led to the founding of a new academic subdiscipline under the rubric (...) of economic personalism. These scholars attempt to integrate economic theory, history, and methodology with Christian personalism's stress upon human dignity, humane social structures, and social justice. This final volume in the series systematically applies the praxeological and theoretical foundations of the personalist tradition to free-market economic theory. Unlike the previous two, this work defends economic liberty in theologically sensitive terms that reference the personalist tradition, without compromising the disciplinary integrity of either economics or social ethics. The title of Stewart’s biography is a tribute to Alain Locke’s seminal work, The New Negro: An Interpretation. This 1925 anthology highlighted the works of several up-and-coming black writers of the 20th century, planting these authors and, thus, a new black intellectual movement squarely in the public eye. While Alain Locke and John Dewey did not work directly together, Dewey’s philosophical approaches, specifically aesthetic valuation, significantly influenced Locke’s life. John C. The concept of anxiety has long held a central place in psychoanalytic theories of mind and treatment. Yet, in recent years, data from the neurosciences and from pharmacological studies have posed a compelling challenge to psychoanalytic models of anxiety. One major outcome of these studies is the realization that anxiety both organizes and disorganizes, that it can be both symptom and signal. In _Anxiety as Symptom and Signal_, editors Steven Roose and Robert Glick have brought together distinguished contributors to (...) address these different dimensions of anxiety. A section of original papers on "Anxiety as Symptom" covers evolutionary, neuroanatomical, genetic, and developmental perspectives. A complementary section on "Anxiety as Signal" focuses on the meanings and functions of anxiety in the clinical process; contributions address anxiety in its ego-psychological, intersubjective, and relational dimensions.
